Introduction

Your privacy is important, so North Jersey Media Group (also “we,” “our,” or “us”) has created the following Privacy Policy to let you know what information we collect when you visit ShopTheRecord.com (“Site”, or “ShopTheRecord”), why we collect it and how it is used and disclosed. This Privacy Policy applies only to information collected through the Site and does not apply to information we collect by other means (including offline) or through other sources. This Privacy Policy is governed by our Terms of Use. By accessing or using the Site, you consent to the data practices prescribed in this statement.


What Information Is Collected?

Personally Identifiable Information:  Personally Identifiable Information, or PII, means any information that may be used to identify an individual, including, but not limited to, a first and last name, home or other physical address, an email address, phone number or other contact information, whether at work or at home. ShopTheRecord collects Personally Identifiable Information from you only when you choose to make it available to us on the Site, and may include, without limitation, the city where you live, your zip code, your first and last name, your credit card numbers for fulfilling orders, your billing and shipping addresses, your cell phone number, and your email address. ShopTheRecord also automatically receives and records information on our server logs from your browser, including your IP address, cookie information, the page you requested and information about usage and interaction with ShopTheRecord.com software, products and websites (computer and connection information, device capability, bandwidth, statistics on page views and website traffic).


We may also receive Personally Identifiable Information about you from third parties, including, for example, information about your transactions, purchase history, or relationships with various product and service providers, and your use of certain applications. For example, if you access the Site through a third-party connection or log-in, for example, through Facebook Connect, by “following,” “liking,” adding the ShopTheRecord application, linking your account to ShopTheRecord, etc., that third party may pass certain information about your use of its service to ShopTheRecord. This information could include, but is not limited to, the user ID associated with your account, any information you have permitted the third party to share with us, and any information you have made public in connection with that service. You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to ShopTheRecord’s Site.


User Generated Content means any information, text, images, or other content generated and submitted to or through the Site by users of the Site. This may include comments or questions that arise during normal usage of the Site. Users of the Site should take care not to post information that includes Personally Identifiable Information that the user does not want to be made public or does not want third parties to view or use. Any information posted in any comment areas may be made public. To request removal of your personal information from any comment area, contact us at customerservice@ShopTheRecord.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.


“Non Personally Identifiable Information”: We also collect information about your interactions with the Site in a manner and format that does not identify you as an individual (“Non-Personally Identifiable Information”). Generally, we do not combine or associate Non-Personally Identifiable Information with your Personally Identifiable Information. If we do combine Non-Personally Identifiable Information with Personally Identifiable Information, we treat the combined information as Personally Identifiable Information. We may collect, use, and disclose Non-Personally Identifiable Information as set forth below.


Analytics Information: We may use third-party analytics tools to help us measure traffic and usage trends for the Site. These tools collect information sent by your browser as part of a web page request, including the web pages you visit, your browser add-ons, your browser‘s width and height, and other information that assists us in improving the Site. The third-party analytics services may aggregate the data they collect with data they collect from other websites to enhance their offering of analytical services, but will not use any information they collect for any direct marketing purposes.


Cookies Information:  When you visit the Site, we may (or we may authorize a trusted third party partner to) send one or more cookies
(a small text file containing a string of alphanumeric characters) to your computer that uniquely identifies your browser and lets us help you log in faster and enhance your navigation through the site. A cookie may also convey information to us about how you use the Site (e.g., the pages you view, the links you click and other actions you take on the Site), and allow us or our business partners to track your usage of the Site over time.

A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by following your web browser‘s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site may not function properly if the ability to accept cookies is disabled.

Log File Information:  Log file information is automatically reported by your browser each time you access a web page. When you use our Site, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, and other such information.

Clear Gifs/Web Beacons Information:  When you use the Site, we may employ clear gifs (also known as web beacons) which are used to anonymously track the online usage patterns of our users. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Site.

Device Identifiers:  When you access the Site by or through a mobile device (including but not limited to smart-phones, iPads or tablets), we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a unique device identifier (“UDID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device‘s operating system or other software, or data sent to the device by us. A device identifier may convey information to us about how you browse and use the Site. The device identifier information that we collect does not itself collect or transmit any Personally Identifiable Information to us, however, a device identifier may be used in conjunction with other information in a manner that may constitute Personally Identifiable Information. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Site. Some features of the Site may not function properly if use or availability of device identifiers are impaired or disabled.

Location Data: When you utilize the Site by or through a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey to us information about how you browse and use the Service. The location data that we collect does not itself contain or transmit any Personally Identifiable Information to us, however, location data may be used in conjunction with other information in a manner that may constitute Personally Identifiable Information. Some features of the Site, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.


How Is Your Information Used?

Personally Identifiable Information:  Personally Identifiable Information collected by us is used to provide you with the products that you purchase from the Site. We collect your email address that acts as your login to the Site and we will use this email address to send you notifications while using our Site. We collect your first and last name and your phone number to provide you quality customer service.Your credit card information is collected when you place an order with ShopTheRecord for our products and your billing and shipping address are collected to fulfill these orders. We may use your Personally Identifiable Information to provide you with product information, support the services offered on the Site and to notify you of technical updates, changes in policy or other customer services. We may contract with one or more third party agents to provide the ShopTheRecord website. These third parties may include credit card processing companies, website designers, website hosting companies, product manufacturers and others who assist in providing the information, systems or materials to provide the Site to you. Selected parts of your Personally Identifiable Information may be shared with these third party agents in order to provide you with access to the ShopTheRecord Site and products that you purchase. We also use your Personally Identifiable Information to send you Site-related emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Site, technical and security notices). You may not opt out of Site-related e-mails.

We will retain your Personally Identifiable Information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you products and/or services contact us at customerservice@ShopTheRecord.com. We will retain and use your Personally Identifiable Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.


Non-Personally Identifiable Information: We use or may use cookies, log file, device identifiers, location data and clear gifs information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of the Site; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems reported by our users or engineers that are associated with certain IP addresses; (f) help you efficiently access your information after you sign in; and (h) track User Generated Content and users to the extent necessary to comply as a service provider with the Digital Millennium Copyright Act.

How Is Your Information Shared or Disclosed?

Personally Identifiable Information: We do not share, sell, rent, or trade your Personally Identifiable Information with third parties except for the purposes of providing you access to the Site and for shipping products that you purchase to you.  We may share your Personally Identifiable Information with our trusted third party partners who assist us in operating our Site, conducting our business, or servicing you, so long as those parties agree to keep your Personally Identifiable Information confidential.  As further described in this paragraph, Personally Identifiable Information collected from you is only disclosed by us to complete and support your purchases from and your use of the ShopTheRecord Site and to comply with any requirements of law.  For example, when you purchase a product on the Site and select a shipping method, your Personally Identifiable Information (including your contact information) will be forwarded to a common carrier and/or our fulfillment contractors in order to ship the product to you. We may also disclose Personally Identifiable Information if required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on us (2) protect and defend our rights or property; or (3) act in urgent circumstances to protect the personal safety of users of ShopTheRecord, or the public. Any Personal Identifiable Information or content that you voluntarily disclose for posting to the Site, such as User Generated Content, becomes available to the public, as controlled by any applicable privacy settings. We may at any time buy or sell/divest the company, or any combination of our products, services, assets and/or businesses. Personally Identifiable Information such as customer names and email addresses, and other user information related to the Service will likely be one of the items transferred in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions or similar transactions or proceedings.


Non-Personally Identifiable Information: We may share Non-Personally Identifiable Information, including information obtained through tools such as cookies, log files, device identifiers, location data and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with our third-party business partners for the purposes described in the section above on “How Is Your Information Used.” We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with our third party business partners.

Online Advertising: We may also share Non-Personally Identifiable Information with our business partners to deliver online advertisements (“ads”) that may be of interest to you. We may allow third-party ad servers or ad networks to serve advertisements on the Site. These third-party ad servers or ad networks use technology to send, directly to your browser or mobile device, the ads and ad links that appear on the Site. These ad-servers and ad-networks automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, device identifiers, location data, and clear gifs, see above) to compile information about your browser‘s or device‘s visits and usage patterns on the Site (without using any Personally Identifiable Information), and to measure the effectiveness of their ads and to personalize the advertising content. We do not sell, rent, or share your Personally Identifiable Information with these third-party ad servers or ad networks for those parties‘ own marketing purposes, unless you choose in advance to have your information shared for this purpose. However, please note that if an advertiser asks us to show an ad to a certain audience and you respond to such an ad, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach. In addition, third-party advertisers may use Non-Personally Identifiable information (e.g., information that does not include your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements on this and other websites about third-party goods and services that may be of interest to you. Your Choices About Your Information

We will use your email address to send you promotional notifications while using our Site. You may opt out of these promotional notifications at any time. We will send you strictly Site-related announcements on rare occasions when we deem it is necessary to do so. For instance, if our Site is temporarily suspended for maintenance, we may send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, please contact customer service. Users can use their account management page to make modifications to any preferences applicable to providing the ShopTheRecord Service. You can also use the account management page to modify, amend or delete any information you provide to the Service. This information can be modified in the “My Account” section of the Site, once you‘ve logged in. We comply with the federal CAN-SPAM Act of 2003 and will not sell, rent, swap, share or authorize any third party to use your email address without your prior permission.


Opting Out of Collection of Personally Identifiable Information

You may, of course, decline to submit any Personally Identifiable Information through the Service, in which case we may not be able to provide certain services to you (you will not be able to purchase any products from the Site, for example).


Opting Out of Collection of Non-Personally Identifiable Information

The only way to completely “opt out” of the collection of any information through cookies or other technology is to actively manage the settings on your browser. Please refer to your browser‘s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Note that disabling cookies on your browser prevents us and our business partners from tracking your browser‘s activities in relation to the Site, and for use in targeted online advertising. However, doing so may disable many of the features available through the Site.


Information Safeguarding Measures: 

ShopTheRecord uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of all information collected through the Site. ShopTheRecord protects the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts the information you input. We also protect against credit card fraud by only showing the last five digits of a customer‘s credit card to confirm orders and when updating credit card information. All credit card information is not stored, but is transmitted directly to our credit card processor and we limit access to this information only to employees that need to assist in credit card orders, transactions or issues. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Notwithstanding the foregoing measures, ShopTheRecord cannot ensure or warrant the security of any information you transmit to ShopTheRecord or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.


Compromise of Information

In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

International Transfers

All information collected on the Service, including Personally Identifiable Information, may be stored and processed in the United States or any other country in which we or our affiliates, subsidiaries or agents maintain facilities, and by using this website, you consent to any such transfer of information outside of your country. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. and the use and disclosure of information about you, including Personally Identifiable Information, as described in this Privacy Policy.

Children

This Site is not intended for or directed to persons under the age of 18. Any person who provides their information to ShopTheRecord through the Account Login page for new customers or any other part of the ShopTheRecord Site represents to ShopTheRecord that they are 18 years of age or older. In addition, we do not knowingly collect or store any personal information, even in aggregate, about children under the age of 13 in accordance with COPPA (Children’s Online Privacy Protection Act).

Testimonials

We may post and/or print customer testimonials/comments/reviews on our website(s) or in our promotional materials, which may contain personally identifiable information. If we wish to post and/or print customer testimimonials/comments/reviews, we will obtain the customer's consent via email prior to posting the testimonial to post their name along with their testimonial.

Links to Other Sites

If you click on a link to a third party site, [including on an advertisement], you will leave the ShopTheRecord site you are visiting and go to the site you selected. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your personally identifiable information by such third parties, and we cannot guarantee that they will adhere to the same privacy practices as ours.
